Giveaway Official Rules
NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility: This $500 Amazon gift card Giveaway (the “Giveaway”) is open only to individuals who are both: (1) a legal resident of the 48 contiguous United States (including the District of Columbia) who are 18 years of age or older at time of entry; and (2) a Pavlov Media residential fiber Internet customer who leaves a review for Pavlov Media pursuant to these Giveaway Official Rules. All U.S., federal, state and local laws and regulations apply and is void where prohibited.
2. Sponsor: The Giveaway is sponsored by Pavlov Media (“Sponsor”).
3. Agreement to Official Rules: Participation in the Giveaway constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor as to eligibiity, which are final and binding in all matters concerning this Giveaway. Winning the Giveaway is contingent upon fulfilling all requirements as described herein.
4. Entry Period: The Giveaway begins and entries will be accepted from April 1, 2024 at 12:00 a.m. Central Time (“CT”), until April 30, 2024 at 11:59 p.m. CT (the “Entry Period”). Any entry submitted after the expiration of the Entry Period is not eligible for the Giveaway.
5. How to Enter: During the Entry Period, an eligible person must leave a review for Pavlov Media by clicking on “Leave Your Review Here,” which will enter the person into the Drawing for a chance to win the Prize. There will only be one (1) entry per person, regardless of the number of reviews submitted. Subsequent entries from the same entrant will not result in increased chances of winning the Giveaway. The use of any agencies or automated software to submit entries will void all entries submitted by or for that person. Alternatively, you may submit an entry by mailing a postcard to 601 N Country Fair Dr, Champaign, IL, 61821 with your name, address, and review. Mailed entries must be received by the end of the Entry Period.
6. Drawing: At the conclusion of the Entry Period, Sponsor will select the name of one (1) winner in a random drawing of all eligible entries received during the Entry Period (the “Winner”). The odds of being selected as the potential winner depend on the number of eligible entries received during the Entry Period.
7. Prize: The Winner shall receive a five hundred dollar ($500) Amazon gift card (the “Prize”). No cash or other substitution may be made. The Winner is responsible for any tax liability, including any taxes and fees associated with participation in this Giveaway and with receipt or use of the Prize.
8. General Conditions: In the event that the operation, security, or administration of the Giveaway is impaired in any way and for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules; or (b) select the Winner of the Prize at random from among the eligible entries received up to the time of the impairment. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In case of a dispute as to the owner of an entry, entry will be deemed to have been submitted by the authorized account holder of the screen name from which the entry is made. The authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. By entering the Giveaway, you agree to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at https://pavlovmedia.com/privacy-policy/. In the event of any discrepancy between the privacy policy and these Official Rules, these Official Rules shall control and govern. Sponsor may use your data to market future products and services. 9. Release and Limitations of Liability: By participating in the Giveaway, entrants agree to release and hold harmless the Sponsor, its affiliates, and their officers, directors, employees, and agents (the “Sponsor Entities”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any Prize, including, but not limited to: (a) unauthorized intervention in the Giveaway; (b) technical errors related to computers, servers, providers, telephone or network lines; (c) errors in the administration of the Giveaway; or (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt of any Prize.
IN CONNECTION WITH OR ARISING OUT OF THIS GIVEAWAY, IN NO EVENT WILL SPONSOR BE LIABLE TO YOU FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR OTHERWISE, AND WHETHER OR NOT SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
The aggregate liability of the Sponsor Entities in connection with the Giveaway or its subject matter, however caused, and on any theory of liability, including without limitation, contract, strict liability, negligence and/or other tort, will be limited to the cost of entering and participating in the Giveaway, and in no event shall exceed the amount of the Prize, $500, nor include any attorney’s fees or costs. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms and if the invalid or illegal provision were not contained therein.
10. Disputes: Except where prohibited by law, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Champaign, Illinois. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules and Regulations, entrant’s rights and obligations, or the rights and obligations of Sponsor’s in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.
